6am.Kids were full of energy and said they weren't sleepy because they went

Zach said that mommy told
him "It’s nice of daddy to buy you a 65 dollar snake when he doesn't
even pay me child support". Zach said Mommy told him to ask Daddy to
feed his snake next week because Zach won't be able to. Dave asked why and
Zach said mommy told him that they won't be seeing daddy next week. Dave told
Zach that he had not heard any change of plans from Stacy so he is still
planning on picking them up on Tuesday. The neighbor Rob said he will be able
to show us his snake today but he was out. |

|
Stacy came to pick the
kids up after 3pm even though she said she will be coming after getting off
of work at 2pm. Stacy sent Mirrissa up to get her makeup and purse. Then she
sent up Zach to get his toys and play station games even though she doesn't
have Play station at her house. Zach said he wanted to keep his stuff at
Daddy's. Stacy stopped the engine and demanded Zach to get out of the car and
immediately his stuff. Dave went down to talk Stacy but she refused to talk
with the tape recorder. Finally, she ordered Zach to get in the car and drove
off. Later Stacy called saying that Dave will not have the kids on Tuesday
because he had Takako watch them last week and lied to her about wanting to
see the kids. Dave told her that was not a good reason and asked if Stacy has
spoken to her lawyer about this at all. She didn't reply and hung up when
Dave reminded her that she was being recorded. |

Dave was able to speak to the
kids on the second attempt. Mirrissa got a pet gerbil and Zach got a new pet
hamster. Stacy took them to PetMan in south Daytona
and purchased each with new cages and supplies. Stacy told Dave that Mirrissa
wanted to spend her 25 dollars from Grandma on some additional play toys for
the gerbil. Zach said that mommy told him that he now did not need to
reimburse daddy for the snake. Dave said that the agreement was between Zach
and him so mommy can't change it. Zach said that Stacy is still promising to pay
him back for the 25 dollar check from Dolly that he asked mommy to cash for
him. Kids were excited about their new pets and Dave got to hear all about
it. Dave heard arguing about something Mirrissa did to her gerbil’s cage in
the back ground while he talked to Zach. Dave is worried that this will
become a new source of yelling at Stacy's household since gerbils and
hamsters require weekly cage cleaning and daily feeding. |

|
Stacy came on the phone and
much to Dave's surprise, demanded that he should pick up the kids tomorrow.
This was exactly the opposite of what she demanded yesterday but Dave didn't
have any objection so he didn't ask why the change of heart. Stacy told Dave that he needs to cash Mirrissa's birthday check from Dolly and take her to Petman to get an attachment cage because Mirrissa wants
to spend the money on her gerbil. Stacy also said that kids will start school
in Holly Hill so Dave asked why she chose that. Stacy said that the babysitter
can drive the kids to school in the morning and she has custody so it is only
right that they go to Holly Hill. Dave replied that he could do all the
driving for the kids if she dropped them off at his place in the morning,
which unlike the babysitter is actually on the way to her work. He pointed
out that the kids are used to Pine Trail and it is a better school. Stacy
said they only went to Pine Trail because Dave left the family and they had
no choice so she doesn't want to be blamed for that. |

Dave picked up the kids at

Mirrissa begged and
pleaded to spend the money today but Dave reminded her that she promised
mommy to buy a cage for her gerbil. Mirrissa called her mom to ask if it was
OK to spend the money on something else today. Stacy said that it will be OK
if Dave will buy the cage extension for Mirrissa's
gerbil as his birthday present to her. Dave said he already picked out the
gift. Mirrissa said she didn't want to
get a cage for her gerbil but Stacy was able to convince her that her gerbil
needed a bigger cage and that will be the best thing to do. Stacy told
Mirrissa that she will have her allowance next week indicating that Stacy
decided to give the kids weekly allowance in response to Dave starting with
Zach last week. |

|
Zach said that mommy told
him that he can't spend his birthday money from Dolly with his dad and he
must spend it with her. According to Stacy, Zach bought a hamster and a cage with
his 25 dollars. Dave pointed out that Zach had decided to buy the snake first
and it is not right to decide to buy something else with out paying him back.
Zach replied that mommy forbids him to take his money to daddy and she said
he had to spend it at the store with her. Dave said mommy probably shouldn't
have done this but he should also realize that getting the hamster wasn't
right either. Later, Zach said he will pay daddy with his allowance. Dave
said to not worry about it and to consider the UT game and the snake his
birthday present. Zach said he got 2 dollars from mommy to feed his snake
too. When Zach spoke to Stacy, he told her that mice for the snake was
actually a dollar so he can use his allowance instead and give mommy back the
2 dollars she gave him. |

|
Mirrissa said "When
you (Takako) and Daddy cheated on Mommy, I think the second time, mommy
thinks you went to see your parents". Turns out Mirrissa thought that
mommy thought Takako went to see her parents. It had nothing to do with
neither cheating nor anything mommy actually said. Mirrissa then said"
mommy knows where you live" Dave replied, yes I know mommy knows she has
come by before. Mirrissa said, "we went there late a night but daddy
wasn't there most of the time". |

|
|
Zach said he was sad he didn't get any
presents for his birthday. When asked to clarify, he said he wanted a
birthday party where people bring him wrapped presents and he gets to open them.
Takako said maybe next year when the schedule is set, we can make some plans
for a party. Zach said that mommy will probably get him and he will never get
a party anyway. Takako told him that we won't know that but the fact your mom
and dad are fighting to get you guys must mean you are pretty special to
them. Zach nodded his head and said "I will probably never get to see
daddy though". Zach also volunteered that Mirrissa is telling mommy that
Takako is mean to her even though he knows that’s not true. Zach was still
grounded from all is friends forever. |

Dave went with Takako to
appointment with Jane Devine. Ms. Devine thought it best if Takako didn't
join them today so Takako went out to the antique shop to kill time. Dave
went over the school situation and gave Ms. Devine the most recent court
papers. Stacy arrived after 15 minutes. Most of the session was taken up with
Stacy and Dave arguing. Stacy would say one thing and Dave would say
"that’s not true". When JD asked Stacy what was wrong with Pine
Trail, Stacy didn't have a response. Dave made it clear that he just wanted
the kids to go to the best school possible regardless of where it was. Stacy
tried to bring up child support but JD redirected her to discuss one thing at
a time. JD said it would be best we you guys can agree on this before Monday
when you are scheduled to go to court. |

|
Stacy didn't know anything
about the court date and had heard nothing from her lawyer. JD made a copy of
the motions for Stacy. At the end of the session, they agreed that Zach will
come for a session next week and Stacy will bring him, and the following
week, Dave will bring him. Dave told JD that although Stacy may think Zach is
the source of all problems, he believes there are serious things going on
with Mirrissa and he would like her in therapy. JD said lets work on one kid
at a time. Dave reluctantly agreed.
Stacy was seen driving off towards south Daytona from JD's office so
Dave was concerned she didn't pick up the kids and went to her lawyers
office. It turned out she did go pick up the kids after work and left them
somewhere for the appointment. Late that afternoon, Takako dropped off papers
to Michelle. Stacy was seen talking to her lawyer on a cell phone as she
walked away from JD's office. |

Stacy left a voice mail on
Dave's phone saying he has the kids this weekend but she gets them next
weekend to get the schedule back to where it used to be. Dave called back and
said that no he doesn't want to change anything anymore and Stacy has the
kids this weekend but he can baby-sit while she works if she needs him to.
Stacy went on about how inconsiderate he was and how kids should at least be
given a chance to try out Holly Hill without being jerked out of a school
AGAIN by Dave. Dave said he was tired of his kids losing out on opportunities
because of Stacy's poor choices. Stacy asked "when have I ever stood in
your way". Dave named numerous incidents. Stacy jumped from one topic to
the next despite Dave trying to stay on the topic of kids' school and weekend
schedule. |

spoke to Zach briefly. Zach mostly talked about his snake. He got in trouble
for playing with Kyle and shooting his bbgun into a
window and breaking it. He said mommy grounded him from his friends. Takako
thought it amusing that he now has two life sentences of grounding to live
through. Zach also told Dave that mommy is still going to make him pay back
500 dollars for the couch. |

Saturday. Takako had Real
Estate school so Dave and the kids met up with her for lunch at school.
School is located in a remodeled mall. Kids had fun going up and down the
escalators while they waited for her to get out of class. They went to Arby's and had roast beef sandwiches. Kids wanted to go
to Toy's Rus to spend their birthday money. Zach
purchased a remote control plane which cost 50 dollars. Dave helped him out
with 10 additional dollars. Mirrissa purchased a small oven to bake tiny
cookies and Twinkies. Carey joined them when they got back and played with
their new toys. Zach brought back the earring Takako gave him from his mom's
place. He said his mom told him never to wear it again because his ear will
become infected with germs if he wears Takako's
earring. Zach didn't believe her and asked Dave if he could wear it at
daddy's house. Carey was very happy to visit with us. She said Dave and
Takako were her favorite people after her mom. Her mom said that Carey looks
across the street to see if the jeep is there and looks forward to the kids'
visit every weekend. She ran over and gave Takako a hug as soon as she came
home from school. Carey also volunteered a goodnight hug. Seeing this, Zach
also came over and gave Takako a hug goodnight. |

to school. Kids had waffles for breakfast and played with Carey until it was

Stacy called in the
afternoon asking where this month's and the last half of last month's child
support was. Dave told her he is waiting for the court order because as far as
he was concerned, he was paid up for the year. Stacy yelled back "how
can you say that when the kids are suffering because you aren't paying
me!" She then accusingly said Dave needed to pay Michelle the baby
sitter. Dave told her he didn't see why he should when there is no need for a
babysitter. Stacy screamed at him incoherently and hung up the phone. Dave
called and spoke to Zach, Mirrissa could be heard saying "I don't want
to talk". Stacy continuously tried to get Zach to get off the phone.
Dave asked what he is learning in school. Zach said multiplication and
addition. Dave asked how much he was suffering. Zach said he was not
suffering at all. Stacy hearing this convinced Zach to hang up the phone. |

Tuesday. Dave received
reply from Stacy's lawyer Mr. Fox on the petition. Dave tried reaching the
kids from work but nobody answered. Takako spoke to JD on the phone. Jane
Devine was under the impression that Dave wanted Zach in first because of his
severe behavioral problems. She said she recommended bringing both kids to
share the session 20 minutes each and that is what Stacy is going to do. She
didn't know Dave thought anything special about mirrissa.
She asked Dave remind Stacy to bring both kids. Takako told her that Stacy
will bring both kids anyway if she doesn't have a babysitter and if Dave told
her, she would make sure she only took Zach. Dave and Takako were shocked
that there was such big misunderstanding about the issues with Jane Devine. |

Court date. Counseling is
court ordered. Due to Stacy having custody, judge decided not to go against that
so kids will go to hilly hill for the year. On the way back we stopped to get
a mice for Zach's snake. Dave called Stacy to ask if Zach could come visit to
feed his snake. Surprisingly she called back at 3:30pm and said she will
bring him over but he can opnly
stay for 45 minutes. Dave agreed and Zach showed up at 3:45. Dave not having
heard back from stacy had already fed the snake but
Zach enjoyed watching the buldge in his snake's
stomach. Zach wanted to bake brownies and as they put it in oven time was
up. At 4:20 Stacy drove up and honked
her car. Zach hurriedly put on his shoes and left. As the door closed, we
heard Stacy yelling "what is taking you so long! I told you to be
waiting for me!" and Zach replying "I'm coming,
I'm just putting my shoes on!" Mirrissa was also in the truck and she wa yelling "Bubba you better get in here!

Zach was wearing his
glasses. Zach said he had a head ache all last week and mommy told him that
if he didn't wear his glasses even for one day, he will go blind. Dave looked
at him funny and Zach repeated this numerous times. |

Friday. Dave called the
kids. Stacy and the kids were at her coworker's house. They were watching
Scooby doo. Zach came on the phone but was
distracted and said he wanted to go back to watching the show. Mirrissa
didn't want to talk to Dave. Dave went to Takako's
house for the weekend. Stacy did not ask Dave to baby sit the kids for the
weekend. |

woke up late and Dave cooked chocolate pancakes for breakfast. Carey came
over and showed us her new light up toy she got on her trip to Busch Gardens. |

Stacy said "how nice of
you to want to speak only to Zach, when you also have another child here,
maybe you could speak to her once in a while." Surprised, Dave told her
he just got done talking with Mirrissa. Stacy called him a liar and said he
never talked to her. Dave encouraged her to check her call logs on her cell
phone. Stacy grunted and passed the phone to Zach. Zach came on the phone and
started talking. He said he wanted to go visit his friend then the line went
dead after a click. Dave called back and Stacy answered "what!" He
told her they got disconnected and asked to speak to Zach again. Stacy said
"I don't know, he was the one who hung up on you" and passed the
phone to Zach. Zach said he wants to talk to Dave but he wants him to call
him later. Dave said probably not tonight but he will call Zach tomorrow night. They said goodbye. |
