          The parenting document revised by Stacy after I wrote down what she told me over the phone. She again put in "to be determined when the time comes."  She just can't seem to get her head around the "time to determine" is NOW.

          Not surprisingly, this was thrown out by Stacy's lawyer Mr. Fox, when she showed it to him. When he spoke to me, he seemed surprised to learn that I had just typed up what Stacy told me to write. I wonder if he thought I was that stupid.  But then, I guess I am. He started from scratch using his own template and drafted a plan for the kids. 

 

 

PARENTING SCHEDULE

 

Both Parents have joint legal responsibility for said children, Zachary Bryce Prather and Mirrissa Lynn Prather, be ordered. Natural Parents Ms. Stacy Ann Erickson and Mr. David Lee Prather shall share and participate in the joint legal responsibility for said biological children.

 

The residential arrangements defined below are provided for the best interests of the children. The children's interests are best served by a full and regular pattern of contact with both Parents, responsiveness and cooperation by both Parents.

 

Beginning Friday [      /       /      ], the following PERMANENT Parenting schedule shall be in effect:

 

REGULAR PARENTING SCHEDULE

  • Mother shall have the children on all school nights to ensure stability for the children's education.

 

  • Father shall have overnight visitation with the children only on non school nights.  This will typically be from Friday after school to Sunday at 8pm as to not interfere with the stability for the children's education.

 

  • Father shall have every possible opportunity to provide children with dinner and child care on school nights provided they are between the hours of 2pm to 8pm. 

 

  • Summer vacation schedule to shall be determined at a later date upon discussion by both parents. In the event agreement is not reached by the last day of school, the following schedule will automatically take effect. Children will reside with each parent for one week at a time starting on Friday evenings until school commences at which time the regular parenting schedule will take effect.  as follows. Mother shall have the children from the day school lets out for summer vacation for a minimum of 7 overnights. Children shall be exchanged between 6am and 9pm on eighth day at a time agreed to by both parents. Father shall return the children to the mother's residence minimum of 7 overnights before school resumes.

CONFLICTS CLAUSE: Special days and Holidays shall prevail over regular parenting schedule.

 

HOUSEHOLD RULES

1.      David agrees to never cut or dye Mirrissa's hair for any reason whatsoever. Stacy agrees to maintain Mirrissa's hair and will always ensure that her hair does not cover any part of Mirrissa's eyes.

 

2.      David agrees to never threaten Stacy with the kids.

 

3.      David agrees that Stacy's instructions given over the telephone shall be followed by both children over instructions given by Takako.

 

4.      David agrees to make every effort to ensure that Takako always speak pleasantly to both children at all times.

 

5.      David agrees to not allow Zachary to be outside for the purpose of picking up strange snakes.

 

6.      David shall make every effort to communicate with Stacy and understand Stacy's feelings. David agrees to attend and pay for counseling sessions in order to improve his communication skills and to better understand Stacy. Stacy shall make every effort to attend these sessions with David to facilitate his understanding.

 

7.      David shall not call Stacy any names whatsoever.

 

8.      David shall help out with the care of both children by helping paying for food, clothing and paying his child support.

 

9.      David agrees to pay $450 dollars per child, per month in child support to Stacythe mother based on Florida State Child Support Guidelines.

 

10.   Stacy agreesChild support to make every effort to maintainthe mother shall continue while the child resides with the mother and mother maintains full time employment of 40 hours or more per week.

 

11.  Child support to Stacythe mother shall continue until the child finishes high school,  or turns 18 years of age, or until the child no longer resides in her home whichever occurs earlier.

 

12.  Stacy shall attend a parenting class as ordered by the court for divorcing parents.

 

13.  David shall always available to provide child care when Stacy cannot watch the children to make sure she does not have to hire and pay for a babysitter.  In the event child care is needed, David will be solely responsible for arranging and paying for it.

 

14.  David shall make sure to spend more time outdoors with Zachary who is a boy, instead of keeping him in the house in front of a TV or computer. Examples of suitable activities for a young boy include fishing, playing catch, and skateboarding at the skate park. By doing these activities David shall provide Zachary with the type of attention he craves.

 

15.  Each party shall not refuse to surrender said children to the other party or designated responsible adult promptly at the beginning of each of the party’s parenting time. The Parent ending his/her parenting period shall leave the premises immediately after delivering said children.

 

16.  During exchanges, each party shall not initiate conversation or direct comments to be heard by the other party.  Polite and courteous manners by both parties are agreed and theThe party returning said children from a parenting time shall stay in the parked car as courtesyand may only exit the car to open the otherdoor and help the child out of the car or to help unload any belongings to the sidewalk. The party receiving the children may not approach the vehicle, or address the children while the vehicle is in the vicinity. When the returning party's vehicle has departed, the receiving parent may walk up to help the children with any belongings.

 

17.  Each Party shall not deny parenting or visitation rights due to a refusal to provide said financial contribution. Nor shall they speak of or mention any aspect of their grievance regarding financial contributions of the other party in the presence of said children.

 

18.  Each Parent agrees not to use obscene or vulgar language in the presence of the children and shall not allow any other adult to use such language. Obscene or vulgar language is defined as those words and phrases that are not allowed to be broadcast on network television.

 

19.  Each Parent shall make every effort to provide a consistent environment with the best interest of the child in mind while havinghave the right to choose their own Parenting style and punishments, providing their methods and results are not prevented by law and do not constitute abuse.

 

20.  Corporal punishment of said minor children, IF ANY AT ALL, shall be administered only by the natural Mother or the natural Father. Both parties are restrained from allowing any other person to administer corporal punishment to said minor children.

 

21.  Children shall be provided with the best possible educational opportunities available to them within reasonable distance from their residence and is affordable for the parents.

 

22.  Each party shall provide the name, address and telephone number of the daycare, preschool or school, church or contact person for any activity or program, which said children attend. Both Parents names must appear as legal guardians with full parenting privileges on all forms filled out at daycare, school, church or contact person for any activity or program, which said children attend. Copy of the parenting plan must be made available to all of these locations to provide accurate information, including but not limited to custody and residential agreements between parents for said children to all associates, friends and relatives.
